Marino eSIM - Terms and Conditions

1. Definitions

• "Marino eSIM" refers to the digital service operated by our company that offers virtual SIM card (eSIM) connectivity for travelers and seafarers.
• "User," "you," or "your" refers to anyone who accesses, browses, or uses our website or services.
• "Service" means all the digital and mobile services provided by Marino eSIM, including eSIM purchases, activations, and related features.

2. Acceptable Use

• Use the Service only for lawful purposes and in accordance with applicable local and international laws.
• Not engage in unauthorized access, reverse engineering, or distribution of the Service.
• Not misuse the platform for spamming, phishing, hacking, introducing malware, or impersonating others.
• Refrain from reselling, sublicensing, or redistributing Marino eSIM data packages without written consent.

3. Account Registration

• You may be required to create an account and provide personal data (e.g., name, email, payment info).
• You agree to provide accurate and up-to-date information and to keep your account credentials secure.
• You are solely responsible for any activity conducted through your account, and must notify us immediately if you suspect unauthorized use.

4. Fees, Payments & Refunds

• Payment Methods: Certain services require payment, which must be completed using accepted payment methods, including credit/debit cards, GCash, or Maya. All charges are displayed in PHP.
• Currency: All charges are displayed in Philippine Pesos (PHP) and are inclusive of applicable VAT unless otherwise specified.
• Non-Refundable Services: eSIM purchases are non-refundable once activated, except where a technical issue is confirmed on our end or when required by applicable law.
• Price Change: Marino eSIM reserves the right to modify prices at any time without prior notice.

5. Privacy and Data Use

• Your use of our Service is also governed by our Privacy Policy, which outlines how we collect, store, and use your personal information.
• By using the Service, you consent to our collection and use of your data as outlined in that policy.
• We implement industry-standard encryption and data protection protocols, but cannot guarantee absolute security.

6. Intellectual Property Rights

• All content on our website, social media or platform—including logos, designs, images, software, and written material-is the intellectual property of Marino eSIM or its licensors.
• You may not copy, reproduce, republish, or distribute any part of the Service without prior written permission.
• Trademarks and logos used in connection with the Service may not be used without appropriate attribution or license.

7. Service Modifications & Downtime

• We may update, suspend, or discontinue features or the entire Service at any time without liability.
• While we strive for maximum uptime, we cannot guarantee uninterrupted access due to technical, maintenance, or security-related issues.

8. Limitation of Liability

• Marino eSIM shall not be held liable for indirect, incidental, or consequential damages arising from the use or inability to use the Service.
• We do not guarantee coverage or service continuity across all regions, as eSIM performance depends on third-party network availability.

9. Termination

• We reserve the right to suspend or terminate your access to the Service without prior notice if you violate these Terms, engage in fraudulent behavior, or cause harm to other users or the platform.

10. Governing Law

• These Terms are governed by the laws of the Republic of the Philippines.
• Any disputes shall be subject to the exclusive jurisdiction of the courts in Metro Manila.

11. Changes to Terms

• We reserve the right to update or revise these Terms at our discretion.
• Changes become effective once posted on this page.
• Continued use of the Service after changes means you accept the updated Terms.

Fair Usage Policy

The Service, including any “unlimited” data plans, is provided for personal, non-commercial, and reasonable use only. The underlying network providers reserve the right to apply a fair usage limit, including a daily or periodic high-speed data allowance, after which data speeds may be reduced for the remainder of the applicable period. Users must not engage in excessive, abusive, or commercially exploitative activities, including but not limited to automated usage, continuous high-volume consumption, peer-to-peer sharing, or resale of the Service. The providers may monitor usage patterns and, without prior notice, reduce speeds, suspend, or terminate the Service in the event of a breach of this policy. Service performance may vary based on network conditions, location, and third-party providers. The Company acts solely as a reseller of the Service and shall not be held liable for any reduction in speed, suspension, limitation, or termination imposed by the underlying providers. Applicable policies may be amended from time to time, and continued use of the Service constitutes acceptance of such changes.
